Accident claims made clear

With so much bad publicity about badly handled and expensive personal injury claims, you need someone you can trust to do the best for you. We at Newbys Solicitors offer our wealth of experience to guide you through your claim simply and efficiently.

What costs are involved?

Newbys Solicitors are happy to act on a no win no fee basis. This means that if you do not win your case you will not have to pay your own legal fees and if you are successful in your claim you will retain 100% of any compensation that you recover. Because under English law if you are unsuccessful, you may be required to meet your opponent’s costs, it may be necessary to take out an after the event insurance policy. We can advise you on the circumstances when this would be necessary, negotiate deferred insurance premiums where possible and in any event advise you on a face to face basis of the pros and cons of your case, the likely fees involved and the risks that you face.

How long will it take?

It is difficult to be precise because of the wide range of accident and personal injury claims but they often take between nine and twelve months but can take up to two years depending on a variety of factors for example the type of injuries that you have suffered and whether fault for the accident is admitted or whether court proceedings prove necessary.

What should I do first?

If you think you have an accident or injury claim then you should contact us for an informal chat; we have offices in Middlesbrough, Stockton-on-Tees and Guisborough. One of our personal injury solicitors will go through details with you and advise you if you have a claim that is worth pursuing and will then advise you on the next step that you need to take.

In what circumstances might I have a claim?

If you have been involved in an accident that was someone else's fault you may be able to claim compensation. The types of accident might include road traffic accidents, accident at work, tripping or slipping or victim of criminal injuries. If the accident took place more than three years ago then you may be too late but if you were involved in an accident that took place within the last three years then you should contact us and we will discuss your accident advice to see whether you have a claim and that you know your options.

Why use a local solicitor rather than a claims company?

It is important that you have confidence in your legal advisor from the outset of your claim throughout the entire process. Claims companies often employ junior members of staff to keep the costs down and often require you to use a Solicitor that is based a long way from where you live and where you are not given an opportunity to meet personally with your lawyer. Using a claims company often means that your legal advisor is not experienced enough to advise on complex legal issues and they are often not sufficiently qualified to take your case to court if that becomes necessary. Instructing Newbys Solicitors means that you have access to well qualified specialist advice from local Solicitors who you are able to meet and discuss issues that arise face to face.

Can you visit me at home or in hospital?

Yes, out of office appointments can be arranged if this is necessary.

How does the process work?

If you decide to proceed with your claim then we will conduct the whole case on your behalf. We will write to the person or organisation who caused the injury and obtain medical evidence. We will prepare a full schedule of the expenses that you are claiming, negotiate with insurers and if it is not possible to settle your claim then we will start court proceedings on your behalf and take the matter to court.

How do I make a claim?

If you think that you have a claim then the first thing is to contact us for an informal chat. We will go through the details with you and advise you as to whether you might have a claim. We will contact you to discuss the next step.
